Terms and Conditions
The terms that apply when you use our website or order construction estimating and takeoff services.

1. Acceptance of Terms
These Terms and Conditions (“Terms”) govern your use of newyorkcostestimating.com (the “Website”) and the construction estimating, quantity takeoff, consulting and related services (the “Services”) provided by New York Cost Estimating (“we”, “us” or “our”). By using the Website, requesting a quote or ordering Services, you agree to these Terms. If you are accepting on behalf of a company, you confirm you have authority to bind it. Our Privacy Policy is part of these Terms.
2. Description of Services
We prepare quantity takeoffs, material takeoffs, cost estimates, bid estimates, budgets, change order pricing, value engineering options, Xactimate estimates and consulting reports based on documents and information you provide. Service descriptions are available on our Construction Cost Estimating Services page and related service pages. The specific scope, deliverables, fee and delivery date for each project are confirmed in our written quote.
3. Quotes, Orders and Scope
Quotes are based on the documents and scope provided at the time of the request and are valid for the period stated in the quote. An order is accepted when you approve the quote in writing (including by email) or make payment. Work outside the quoted scope — including addenda, design changes, additional trades or alternates — may require an additional fee, which we will confirm before proceeding.
4. Fees and Payment
Fees are stated in U.S. dollars. Unless otherwise agreed in writing, payment is due as stated on the quote or invoice, and we may require payment before delivery of final files. Late payments may delay current or future work. See Construction Estimating Pricing for general information about how fees are set.
5. Client Responsibilities
- Provide complete, current and legible drawings, specifications and addenda;
- Clearly identify the scope, trades, labor basis and project location to be estimated;
- Confirm you have the right to share the documents with us;
- Review deliverables promptly and report questions or errors within a reasonable time.
Our estimates depend on the accuracy and completeness of the information you provide.
6. Nature of Estimates
An estimate is a professional opinion of probable cost based on available documents, stated assumptions and market conditions at the time it is prepared. It is not a guarantee of actual construction cost, bid results, subcontractor or supplier pricing, or project profitability. Actual costs can vary due to market changes, material escalation, labor availability, design changes, site conditions, schedule, means and methods, and other factors outside our control. You are responsible for reviewing, adjusting and approving any estimate before using it in a bid, contract, budget or financing decision. Our methods and checks are described in our Estimate Accuracy and Quality Policy.
7. Delivery and Revisions
We will make reasonable efforts to meet the delivery date stated in the quote. Delivery dates depend on receiving complete documents and timely answers to questions. Revisions to correct errors in our work are provided at no charge. Revisions caused by new information, addenda or scope changes may be billed separately.
8. Intellectual Property and Use of Deliverables
Upon full payment, you may use the deliverables for your internal business purposes and for the project they were prepared for, including sharing them with owners, lenders and project team members. Our templates, methods, formats, software configurations and Website content remain our property. Website content may not be copied or republished without permission. Project Documents you provide remain your property or the property of their owners.
9. Confidentiality
We treat Project Documents and estimates as confidential and use them only to provide the Services, as described in our Privacy Policy. You agree not to publish our deliverables in a way that represents them as a guaranteed price or as the work of another party.
10. Limitation of Liability
To the fullest extent permitted by law, our total liability for any claim arising from the Website or Services is limited to the fees you paid for the specific Service giving rise to the claim. We are not liable for indirect, incidental, consequential, special or punitive damages, including lost profits, lost bids, delay costs or loss of business, even if advised of their possibility.
11. Disclaimer of Warranties
The Website and its content are provided “as is” for general information. Articles, cost ranges and examples on the Website are educational and are not a substitute for a project-specific estimate or for professional legal, engineering or financial advice. See our Disclaimer for more.
12. Indemnification
You agree to indemnify and hold us harmless from claims arising from your misuse of the Website or deliverables, your breach of these Terms, or documents you provide that you did not have the right to share.
13. Cancellation
You may cancel an order by written notice. Fees for work already completed up to the cancellation date remain payable. We may decline or cancel work if documents are incomplete, if payment terms are not met, or if a request conflicts with these Terms.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Kings County, New York, and you consent to their jurisdiction. Before filing any claim, both parties agree to try to resolve the matter informally by contacting the other in writing.
15. Changes to These Terms
We may update these Terms from time to time. The updated Terms apply from the “Last updated” date. Terms in effect when you accepted a quote continue to apply to that order.
